The successful bidders check will be considered down payment and deposited in an escrow account until closing. Closing will take place within 30 days of the auction. All other cashiers checks will be returned to non-successful bidders.
CONDITION OF SALE
This auction is conducted "AS-IS-WHERE-IS", no warranties and none implied. A form 17 "sellers disclosure statement" has been filled out on all properties and is available for your inspection prior to the auction. Western Real Estate Auctions has no knowledge of defects in any of the properties listed for sale at auction. Western Real Estate Auctions urges you to do your due diligence on all properties prior to the auction as no refunds will be issued for any reason after the auction. Western Real Estate Auctions/Bill Snyder, Agent for Liberty Properties and it's representatives assume no liability for the condition, zoning, visible or hidden defects of any of the properties and has no knowledge of same. "Buyer Beware" (NOTE! Be aware, the 15.58 acres in Dome Valley is presently zoned R-40 and will need to be rezoned to R-15 to build on the property.)In addition let it be known, this is not a distress, foreclosure, nor other negative type auction. These properties are being sold at auction only as an other means to sell real estate. All legal paperwork will be handled by Bill Snyder, of Liberty Properties, a licensed real estate agent in Arizona. Western Real Estate Auctions is not nor do they claim to be a licensed real estate broker in Arizona but are working with one as required by law. They are bonded and insured in the state of Arizona as required. Their capacity is to act only as coach in a representative capacity and as an independent contractor in the sale of the subject properties at auction. All sales are final and a 6% "buyers premium" will be added to all final bids.
TERMS and CONDITIONS:
6% BUYERS PREMIUM IN EFFECT All bidders must arrive prior to 11:AM starting time to register. All bidders must prequalify which requires they submit to our clerk a "cashiers check" made out in their name in the amount of $5000.00. You must present the cashiers check in order to receive a bidder number, NO EXCEPTIONS! If you are a successful bidder your cashiers check will be considered down payment on the property and deposited in an escrow account at Chicago Title in Yuma. The balance on all properties purchased is due and payable at closing within 30 days of the auction or by Monday April 7, 2008 at the latest. Exceptions may apply if required by Chicago Title only. If you are the successful bidder, under no circumstances will your check be refunded. All non successful bidders cashiers checks will be refunded immediately after the auction. Closing will take place on or before April 7, 2008 at the offices of Chicago Title, 1706 So. 4th Ave. Yuma, Arizona. Any and all taxes, fees, etc. will be divided among buyer and seller per standard real estate closing practices at closing.
TERMS OF AUCTION:
All bidders must be signed up and have their $5000.00 cashiers check submitted to our clerk no later than 11:AM to recieve a bidders packet and number. The 15.58 acres in Dome Valley and the 1/2 acre lot in Concho Lake area will be sold "ABSOLUTE" regardless of final bid. All other properties sold are subject to "SELLER CONFIRMATION" of final bid meaning seller can accept or reject the final bid. THEIR DECISION TO ACCEPT OR DENY THE HIGH BID IS FINAL! NOTE: A 6% BUYERS PREMIUM WILL BE ADDED TO ALL FINAL BIDS.
PURCHASE / SALE AGREEMENT:
A purchase /sale agreement between buyer and seller will be completed immediatly following confirmation an acceptable bid has been made. Bill Snyder, Broker for Liberty Properties will be responsible for paperwork to complete the sale and will assist with closing of the properties. Closing will take place within 30 days of the auction and on or before April 7, 2008 at the offices of Chicago Title, 1706 South 4th Ave., Yuma, Arizona. Bill Snyder will contact all successful bidders and set up times for signing closing documents. A title report will be prepared and clear title will be conveyed at closing.
