BUYER'S PREMIUM
A Ten Percent (10%) Buyer's Premium will apply to all purchases.

SALES TAX
If you are purchasing items at auction and you live in the state the merchandise is being sold in, we are required to collect sales tax on those purchases.

PAYMENT TYPES
Cash, Cashier Checks, Wire Transfers, and Credit Cards with 3% Service Fee

AS IS, WHERE IS
All property is sold "AS IS, WHERE IS" and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Winning-bidder.com and Western Auction Company may attempt to describe the merchandise in advertising, on the internet and at the auction, but make no representations to the exact condition of the items to be auctioned. Winning-Bidder.com and Western Auction Company shall not be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.

It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Bidder is allowed and expected to view the item(s) that are being offered for bids. If Bidder chooses to bid without examining the items it is not the responsibility of Winning-Bidder.com and Western Auction Company.

Winning-Bidder.com and Western Auction Company shall attempt to describe in detail each item and any pertient information about that item. Winning-Bidder.com and Western Auction Company are not responsible for any errors or omissions in the description of the items.

Bidder agrees that everything is sold "AS IS, WHERE IS" and that they may not return any item they purchase.

BIDDING AND BID RETRACTION
When placing a bid, Bidder acknowledges and agrees to all terms and conditions of the auction and agree not to retract the purchase offer. If you cannot satisfy the terms of the auction, PLEASE DO NOT BID.

INTERNET FUNCTIONS
Winning-Bidder.com and Western Auction Company is providing a service to Bidder. Bidder acknowledges that Winning-Bidder.com and Western Auction Company is not responsible for malfunctions, shutdowns, or temporary loss of service that may occur. Under no circumstances shall Bidder have any kind of claim against Winning-Bidder.com and Western Auction Company. If any malfunction or loss of service occurs Winning-Bidder.com/Western Auction Company reserves the right to delay the auction closing or take other actions that would remedy the situation.
